There are many terms used interchangeably to describe those in the legal profession in Australia; lawyer, solicitor, and barrister are the most common. They do not all mean the same and they play a different role in your Family Law matter.

Firstly, a lawyer is a person who has been admitted to the legal profession and therefore includes all judges, barristers, and solicitors. Simply, it is a blanket term for those in the profession.

A solicitor is a legal practitioner who advises clients, acts for them, and represents them in their Family Law matter.  They hold a practicing certificate in their respective state, which entitles them to provide legal advice to clients. They will also undertake the majority of the preparation for your matter; however, they may brief a barrister to appear in Court on the day. It is your solicitor with who you will frequently speak and discuss your concerns.  

A barrister is a term for those lawyers who are members of the bar. They are specialist advocates who are trained to appear in a courtroom and cross-examine witnesses. They are also able to provide advice to solicitors on complex issues within a matter. They will only correspond through your solicitor and it is likely that you will have little interaction with them except when your matter goes to Court.
